Distribution Record Date: As a prerequisite to a distribution to unsecured creditors holding allowed claims in Class 3A, the Litigation Trustee of the NP Creditor Litigation Trust is required to establish a "Record Date" for purposes of determining the addresses to which distributions will be delivered. The Litigation Trustee is setting March 4, 2013 as the Record Date, solely for purposes of the initial distribution to unsecured creditors with allowed claims. The Litigation Trustee will establish separate Record Dates for each subsequent distribution to unsecured creditors. General Information: On September 7, 2011, each of the 14 Reorganized Debtors filed voluntary petitions for relief under Chapter 11 of the United States Bankruptcy Code (the "Bankruptcy Code"). The cases are jointly administered under Case No. 11-12804 (collectively, the "Bankruptcy Cases") before the Honorable Kevin Gross, in the United States Bankruptcy Court for the District of Delaware.

On December 14, 2012 the Bankruptcy Court entered the Confirmation Order confirming the Debtors' Modified Fourth Amended Joint Chapter 11 Plan. On December 21, 2012, the Effective Date of the Plan occurred, and the Plan was substantially consummated.
Pursuant to the Bankruptcy Code (specifically including, but not limited to, 11 U.S.C. ยง 362), a debtor is afforded certain protection against its creditors; the Bankruptcy Code prohibits creditors from taking certain actions related to debts that may have been owing prior to the commencement of the Bankruptcy Cases. If you believe that you might be a creditor of the Reorganized Debtor(s) based upon debts arising prior to September 7, 2011 and you are considering taking action based upon your status as a creditor, you may wish to seek legal advice. The staff of the Clerk of the Bankruptcy Court and the staff of Kurtzman Carson Consultants LLC are not permitted to give legal advice.
