Please take notice that the Effective Date of the Debtors’ Fifth Amended Joint Plan of Liquidation Pursuant to Chapter 11 of the United States Bankruptcy Code occurred on June 2, 2017 [Docket No. 326].
General Information:

On January 30, 2017, each of the 12 Debtors filed voluntary petitions for relief under Chapter 11 of the United States Bankruptcy Code (the "Bankruptcy Code"). The cases are jointly administered before the Honorable David R. Jones under Case No. 17-30461 in the United States Bankruptcy Court for the Southern District of Texas.

Pursuant to the Bankruptcy Code (specifically including, but not limited to, 11 U.S.C. § 362), a debtor is afforded certain protection against its creditors; the Bankruptcy Code prohibits creditors from taking certain actions related to debts that may have been owing prior to the commencement of the Bankruptcy Cases. If you believe that you might be a creditor of the Debtor based upon debts arising prior to January 30, 2017 and you are considering taking action based upon your status as a creditor, you may wish to seek legal advice. The staff of the Clerk of the Bankruptcy Court and the staff of KCC are not permitted to give legal advice.

Sale of the Assets

Please take notice that, in accordance with the Bid Procedures Order [Docket No. 116], the Debtors conducted an Auction on March 10, 2017 for the sale of the Debtors’ Assets. At the conclusion of the Auction, the Debtors, in consultation with their advisors and the advisors to the Administrative Agent, selected the final bid submitted at the Auction by BTA Gathering LLC as the Successful Bid.

The Sale Hearing to consider approval of the sale of the Assets to BTA Gathering LLC, was held before the Honorable David R. Jones of the United States Bankruptcy Court for the Southern District of Texas on March 15, 2017 at 10:30 a.m. (prevailing Central Time). Please review the Notice of Successful Bid and Back-Up Bid in Connection with Sale of Substantially All of the Debtors' Assets [Docket No. 149] for additional information.

Please take further notice that the Order (A) Approving the Sale of Substantially All of the Debtors' Assets Free and Clear of Liens, Claims, Encumbrances and Other Interests, (B) Approving Assumption, Assignment and Sale of Certain Executory [Docket No. 172] was entered by the United States Bankruptcy Court on March 15, 2017.

Meeting of Creditors

The meeting of creditors pursuant to section 341 of the Bankruptcy Code (the "Meeting of Creditors") was held on March 8, 2017 at 3:00 p.m. (CT) at the following location:

Rule 9001(5) of the Federal Rules of Bankruptcy Procedure requires that a representative of the Debtors appear at the Meeting of Creditors for the purpose of being examined under oath by a representative of the Office of the United States Trustee and by any interested parties that attend the meeting. Creditors are welcome, but not required, to attend the meeting. The Meeting of Creditors may be continued or adjourned by notice at the meeting, without further written notice to creditors.
