This matter was initiated by an involuntary Chapter 7 petition filed approximately seven months after Brobeck, Phleger & Harrison LLP (“Brobeck”) ceased operations on September 17, 2003 and an Order for Relief was granted on October 10, 2003. The bankruptcy case is pending in the United States Bankruptcy Court, Northern District of California, San Francisco Division (Case No. 03-32715-DM7) before the Honorable Dennis Montali.
Ronald F. Greenspan, the Chapter 7 Trustee (the “Trustee”) of the estate (“Estate”) assumed control of the Estate approximately ten months following Brobeck’s closure after being elected unanimously at the meeting of creditors held November 21, 2013. On December 5, 2003, the Office of the United States Trustee filed a certification of Mr. Greenspan's election as Trustee. Regular reporting to the Office of the United States Trustee under the bankruptcy rules has been undertaken throughout the Trustee's tenure regarding his actions on behalf of the Estate and regarding the financial status of the Estate. Since the Trustee assumed control, Interim Payments have been made to Brobeck's Creditors and the Trustee has now proposed to make a Final Distribution. To that end, and in hopes of finalizing the matter, the Trustee has filed a Final Report and the Trustee and the Trustee’s professionals have filed final fee applications.
Any person who believes he/she did not receive Interim Distribution(s) must send an e-mail describing the relevant facts to BrobeckInfo@kccllc.com and USTPRegion17.SF.ECF@usdoj.govso that it is received by 4:00 p.m. (Pacific Time) on Friday, June 23, 2017. If your e-mail with supporting information is not received by the deadline above, you will waive any objection that you did not receive your interim distribution(s). Any person who objects to the final fee applications or the Trustee's final report must do so in writing, in accordance with the requirements set forth in the Notice.
A hearing on the Trustee’s Final Report and the applications for compensation will be held on July 27, 2017, at 1:30 p.m. in Courtroom 17 (the Honorable Dennis Montali, presiding) in the U.S. Bankruptcy Court located at 450 Golden Gate Avenue, 16th Floor, San Francisco, CA 94102.
