Undeliverable Distribution Checks; Deadline to Submit Application: 6/23/2017

The Liquidation Trustee for the CDC Liquidation Trust has filed his “Supplemental Notice of Undeliverable or Unpresented Distributions Checks” dated March 22, 2017 (the “Supplemental Notice”; Docket No. 1004). Exhibit “A” to the Supplemental Notice lists certain undeliverable or unpresented distributions represented by Distribution Checks from the CDC Liquidation Trust. Please follow this link to view a copy of the Supplemental Notice.

Distribution Checks on Exhibit “A” to the Supplemental Notice were undeliverable or unpresented and must be claimed by their rightful Beneficiaries/owners on or before June 23, 2017. If an undeliverable or unpresented Distribution Check listed on Exhibit “A” is not claimed by the rightful Beneficiary on or before June 23, 2017, then: (1) the Distribution Check shall be void; (2) the funds represented by the Distribution Check will be considered abandoned and deemed Trust Assets not subject to any escheat laws; and (3) the holder of the Beneficial Interests giving rise to the Distribution Check shall have no further claim to such funds or to any subsequent or further distributions from the CDC Liquidation Trust, with such Beneficial Interests being deemed canceled, void and satisfied.

If you are entitled to a Distribution Check or Checks listed on Exhibit “A” to the Supplemental Notice, you must claim the check(s) on or before June 23, 2017. To claim a Distribution Check or Checks on Exhibit “A”: (a) you must complete the “Application for Reissuance of Undeliverable or Unpresented Distribution Check(s)” viewable at this link as Exhibit “B” to the Supplemental Notice; and (b) you must provide a copy of the completed “Application for Reissuance of Undeliverable or Unpresented Distribution Check(s)”, on or before June 23, 2017, to counsel for the CDC Liquidation Trust by sending such application (a) by mail or other carrier to Lamberth, Cifelli, Ellis & Nason, P.A., attn: Elizabeth Miller, 1117 Perimeter Center West, Suite W212, Atlanta, GA 30338, or (b) by electronic mail to EMiller@lcenlaw.com, attn: Elizabeth Miller; or (c) by facsimile to (404) 262-9911, attn: Elizabeth Miller.

After timely receipt of the completed Application for Reissuance of Undeliverable or Unpresented Distribution Check(s), the CDC Liquidation Trust will contact you about any additional steps needed to be completed by you to receive the reissued Distribution Check(s), which may include updating or confirming your address with Computershare, Inc., the paying agent for the CDC Liquidation Trust.
