Pursuant to the Bankruptcy Code (specifically including, but not limited to, 11 U.S.C. § 362), a debtor is afforded certain protection against its creditors; the Bankruptcy Code prohibits creditors from taking certain actions related to debts that may have been owing prior to the commencement of the Bankruptcy Cases. Failure to follow the procedures set forth in the Order [Docket No. 63] shall constitute a violation of, among other things, the automatic stay provisions of section 362 of the Bankruptcy Code. As such, any prohibited purchase, sale, other transfer of common stock or preferred stock, beneficial ownership therein, or option with respect thereto in violation of the Order is prohibited and shall be null and void ab initio and may be subject to additional Court-ordered sanctions.
The meeting of creditors pursuant to section 341 of the Bankruptcy Code (the "Meeting of Creditors") has not yet been scheduled. By Court Order, the U.S. Trustee need not and shall not convene a meeting of creditors or equity holders pursuant to section 341(e) of the Bankruptcy Code if the Plan is confirmed within 75 days following the Petition Date.
Rule 9001(5) of the Federal Rules of Bankruptcy Procedure requires that a representative of the Debtors appears at the Meeting of Creditors for the purpose of being examined under oath by a representative of the Office of the United States Trustee and by any interested parties that attend the meeting. Creditors are welcome, but not required, to attend the meeting. The Meeting of Creditors may be continued or adjourned by notice at the meeting, without further written notice to creditors.
