On February 14, 2016, each of the twenty-six reorganized debtors (the "Reorganized Debtors") filed a voluntary petition for relief under Chapter 11 of the United States Bankruptcy Code (the "Bankruptcy Code"). The cases (collectively, the "Bankruptcy Cases") were jointly administered under Case No. 16-10386 before the Honorable Christopher S. Sontchi, in the United States Bankruptcy Court for the District of Delaware (the “Bankruptcy Court”). On January 10, 2018, the Bankruptcy Court entered an order closing the cases of twenty-five subsidiary Reorganized Debtors, not including Paragon Offshore plc, whose case remains open.
Pursuant to the Bankruptcy Code (specifically including, but not limited to, 11 U.S.C. § 362), a debtor is afforded certain protection against its creditors; the Bankruptcy Code prohibits creditors from taking certain actions related to debts that may have been owing prior to the commencement of the Bankruptcy Cases. If you believe that you might be a creditor of the Debtor(s) based upon debts arising prior to February 14, 2016 and you are considering taking action based upon your status as a creditor, you may wish to seek legal advice. Consistent with the terms of the proposed Fifth Joint Chapter 11 Plan of Paragon Offshore Plc and Its Affiliated Debtors, filed on May 2, 2017 (as may be further amended, modified or supplemented) (Docket No. 1459), on May 17, 2017, the board of directors of Paragon Offshore Plc filed an application for administration pursuant to paragraph 12(1)(b) of Schedule B1 to the Insolvency Act 1986 (the “Application”) with the High Court of Justice, Chancery Division, Companies Court of England and Wales (the “English Court”). The Application has been assigned proceeding number CR-2017-003729.
