On September 15 and 16, 2019, Purdue Pharma L.P. and its affiliated debtors (collectively, “Purdue”) filed voluntary petitions for relief under chapter 11 of the United States Bankruptcy Code. Purdue’s cases are jointly administered under Case No. 19-23649 before the Honorable Sean H. Lane in the United States Bankruptcy Court for the Southern District of New York (the "Bankruptcy Court").
On September 26, 2019, the United States Trustee for Region 2 appointed nine creditors to serve on the Official Committee of Unsecured Creditors (the “UCC”). The UCC is an independent fiduciary for and represents the interests of all creditors in Purdue’s cases.
Plan of Reorganization and Related Appeals:
On June 3, 2021, the Bankruptcy Court entered an order approving the disclosure statement and solicitation procedures related to Purdue’s proposed Plan of Reorganization (the “Plan”). On September 17, 2021, the Bankruptcy Court issued a decision and order confirming the Plan (the “Confirmation Order”). Certain parties appealed the Confirmation Order, and on December 16, 2021, the District Court presiding over these appeals issued a decision (the “District Court Decision”) reversing the Bankruptcy Court and vacating the Confirmation Order. Purdue, the UCC and other creditor groups supporting the Plan then appealed the District Court Decision to the U.S. Court of Appeals for the Second Circuit (the “Second Circuit”). On May 30, 2023, the Second Circuit issued an opinion reversing the District Court Decision, affirming the Confirmation Order and remanding the case to the District Court for further proceedings.
If you would like to ask questions of the UCC, please call (888) 647-1738 (U.S./Canada) or (310) 751-2625 (International) or click here to submit an email inquiry.
